We at Learnship know that you care how we use information about you in the application process. This Learnship EU Candidate Privacy Notice (“Notice”) informs you how we process your personal data. When we speak of “Learnship”, “we”, “us” and “our”, we refer to the Learnship company which is specified in the advertisement or as the context provides. You can find the respective contact details, including the contact details of the data protection officer in the section “Contacts” below). This is also the data controller. Learnship and its affiliated companies will be referred to collectively as the “Learnship Group”.
When does this privacy notice apply?
This privacy notice covers the processing of personal data in the application process as a freelance trainer. Our Trainer Privacy Notice applies for the performance of the contractual relationship as freelance trainer.
What personal data do we process?
We process the following categories of your personal data:
Please do not share sensitive personal data with us unless required by law. Sensitive personal is personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.
How and why we process your personal data?
We will process your personal data to manage your application in the context of a contract as freelance trainer with us, in accordance with Article 6 (1) (b) General Data Protection Regulation. If you consent separately, we will keep your personal data in our Talent Pool to inform you of future opportunities (Article 6 (1) (a) General Data Protection Regulation).
If your application is successful, we will process your personal data for the freelance trainer contract. Please see the Trainer Privacy Notice for further information.
We may also have to process the data in legal proceedings to establish, exercise or defend us against a legal claim, Article 6 (1) (b) General Data Protection Regulation.
All of these processing activities can also be carried out by third parties, in particular other members of the Learnship Group, Article 6 (1) (b) General Data Protection Regulation.
Where do we obtain your personal data from?
You provide us with most of the personal data when you submit your application. We also obtain personal data about you in the course of the application process, e.g. during interviews, assessments or through professional social media.
Do we share your personal data with others?
We may share your personal data only with other Learnship Group companies. This may be the case with limited members of the trainer recruiting, operations, finance, legal or IT department who could be employed by other Learnship Group companies. Also, senior managers in the Learnship Group may access your personal data in the application process. We have taken the necessary steps to ensure that these employees are bound by duties of confidentiality.
Your personal data will in particular be shared with Learnship Networks GmbH because senior executive managers and other central support functions are located here.
In certain circumstances, we share or are obliged to share your personal data with third parties outside the Learnship Group, e.g. external advisors (such as legal advisors, accountants). These parties will act as controllers of your personal data in their own right, and themselves will be responsible for compliance with applicable data protection laws.
Do you use web analytics?
This service uses Google Analytics, a web analytics service of Google Inc, (1600 Amphitheatre Parkway Mountain View, CA 94043, USA (“Google”). Its purpose is the analysis of user activities across websites and devices by assigning data, sessions and interactions across several devices to a pseudonymous user ID.
This processing is based on Section 15 Para. 3 German Telemedia Act (TMG) and Art. 6 (1) (f) GDPR that allows data processing if is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.
Our legitimate interest in this data processing are the analysis of the behaviour of the users of our services as described in the purposes. The data sent by us and linked to cookies, user-identifiers (e.g. User-IDs) or advertising-identifiers are automatically deleted after fourteen (14) months within a month.
How is my personal data secured?
We maintain state of the art technical and organizational safeguards to protect the confidentiality, integrity and availability of your personal data. We have in particular taken appropriate security measures against unlawful or unauthorized processing of personal data, and against the accidental loss of, or damage to, personal data.
How long does Learnship store my personal data?
If you enter into a freelance trainer contract with Learnship, we will process your data for this purpose. Our Trainer Privacy Notice applies then.
If your application is not successful, we will keep your personal data to establish, exercise or defend against legal claims in accordance with the statutes of limitation which vary depending on the country of the data controller you applied to.
What are my rights?
Depending on the laws in your country, you have the right to request access to, correct, or delete your personal data and to ask for data portability. You are also entitled to object to the processing of your personal data in certain instances. If we process your personal data based on your consent, you may withdraw it for the future at any time. You can exercise your right by informing us as outlined in the “Contact” section. In addition, you can lodge a complaint before the competent supervisory authority, e.g. at the place of your habitual EU residence, place of work or place of alleged infringement and before the competent court of the EU Member State where we have an establishment or where you have your habitual residence.
